1. Agreement to Terms

By accessing or using the Winnr mobile application ("App," "Service," "Winnr," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Winnr. We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.

2. Eligibility

You must be at least 18 years of age to use WinnrWinnr. By using the App, you represent and warrant that:

  • You are at least 18 years old

  • You have the legal capacity to enter into these Terms

  • You will not use the App for any illegal or unauthorized purpose

  • Your use of the App will not violate any applicable laws or regulations

3. Description of Service

WinnrWinnr is a mobile application designed to support individuals in their journey to overcome gambling addiction through:

  • Daily check-in tracking and progress monitoring

  • Gamification elements including achievements and trophies

  • Community forum for peer support and discussions

  • AI-powered therapist chat for conversational support

  • Gambling risk assessment quizzes (DSM-5, PGSI, Lie/Bet)

  • Financial tracking to visualize potential savings

  • Mindful intervention prompts when accessing gambling-related apps

  • Premium subscription features

4. Account Registration and Security

Account Creation

To use certain features of the App, you must create an account by providing:

  • A valid email address

  • A secure password

  • Optional profile information

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

  • Notifying us immediately of any unauthorized access or security breach

You agree not to:

  • Share your account with others

  • Use another user's account without permission

  • Create multiple accounts to circumvent restrictions or bans

  • Use automated means to create accounts

5. Subscription and Payment Terms

Free Trial

New users may receive a 7-day free trial of premium features. You may cancel at any time during the trial period to avoid charges. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

Subscription Plans

Premium subscriptions are offered on a recurring basis and are processed through:

  • Apple In-App Purchase (for iOS users)

  • RevenueCat subscription management

Subscription prices are subject to change with notice. Changes will take effect at the start of your next billing cycle.

Billing

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage or cancel your subscription through your iOS Settings > [Your Name] > Subscriptions

Refunds

Refunds are handled according to Apple's App Store refund policy. Generally:

  • Refunds are at Apple's discretion

  • Contact Apple Support directly for refund requests

  • We cannot process refunds for purchases made through the App Store

Premium Features

Premium subscribers receive:

  • Unlimited access to all app features

  • Ad-free experience (if applicable)

  • Advanced analytics and insights

  • Priority support

  • Additional customization options

6. User Conduct and Community Guidelines

Acceptable Use

You agree to use the App in a manner consistent with all applicable laws and regulations. You will:

  • Be respectful and supportive of other community members

  • Share your experiences honestly and constructively

  • Maintain confidentiality of others' personal information

  • Report inappropriate content or behavior

Prohibited Conduct

You may not:

Content Violations:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable

  • Share content that promotes gambling, substance abuse, self-harm, or other destructive behaviors

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

  • Post spam, advertisements, or promotional content without authorization

Technical Violations:

  • Attempt to gain unauthorized access to the App, servers, or networks

  • Interfere with or disrupt the App or servers

  • Use any automated systems (bots, scrapers, etc.) to access the App

  • Reverse engineer, decompile, or disassemble the App

  • Remove, circumvent, disable, or manipulate any security features or copy protection measures

Privacy Violations:

  • Collect or harvest personal information from other users

  • Share or distribute other users' personal information without consent

  • Take screenshots or recordings of private conversations and share them publicly

Community Violations:

  • Engage in harassment, bullying, or intimidation

  • Organize or participate in raids, brigading, or coordinated attacks

  • Create multiple accounts to evade bans or restrictions

  • Attempt to manipulate the achievement or trophy system

7. Content Ownership and License

Your Content

You retain ownership of all content you post, including:

  • Forum posts and comments

  • Profile information

  • Chat messages

  • User-generated contributions

By posting content, you grant Winnr a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and improving the Service. This license continues even if you stop using the App, but only for content that has been shared in public forums.

Our Content

All content provided by Winnr, including but not limited to:

  • App design, interface, and functionality

  • Text, graphics, logos, images, and software

  • AI therapist responses

  • Achievement descriptions and trophy designs

  • Educational materials and resources

This content is owned by Winnr or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.

User Feedback

Any feedback, suggestions, or ideas you provide about the App become the property of Winnr, and we may use them without any obligation to compensate you.

8. Forum and Community Features

Public Nature of Forums

Forum posts, comments, and reactions are public and visible to all Winnr users. Do not share personal information you wish to keep private.

Moderation

We reserve the right to:

  • Monitor, review, and moderate all forum content

  • Remove content that violates these Terms or Community Guidelines

  • Edit or remove content at our discretion

  • Suspend or terminate accounts for violations

No Guarantee of Support

While our community is designed to be supportive, we cannot guarantee:

  • Response to your posts or questions

  • Quality or accuracy of advice from other users

  • That users are who they claim to be

  • 24/7 availability of support

9. AI Therapist Feature

Nature of AI Chat

The AI therapist feature uses artificial intelligence to provide conversational support. You acknowledge that:

  • It is not a licensed therapist or healthcare professional

  • Responses are generated by AI and may not be accurate or appropriate for your specific situation

  • It does not replace professional medical or psychological care

  • Conversations are stored and may be used to improve the Service

  • The AI cannot provide emergency assistance

Emergency Situations

If you are experiencing a crisis, contact emergency services immediately. The AI therapist cannot:

  • Provide emergency intervention

  • Contact emergency services on your behalf

  • Guarantee availability during critical moments

10. Screen Time Integration

By enabling Screen Time integration, you consent to:

  • Winnr monitoring your access to gambling-related apps

  • Receiving mindful intervention prompts when accessing these apps

  • The App using Apple's Screen Time API in accordance with Apple's terms

Important: This feature is designed for mindful intervention, not complete blocking. It is a support tool, not a foolproof prevention system.

11. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Intellectual Property Rights

Trademarks

"Winnr" and associated logos are trademarks of Winnr. You may not use these trademarks without prior written permission.

Copyright

All content in the App is protected by copyright laws. Unauthorized reproduction, distribution, or modification is prohibited.

DMCA Compliance

If you believe content in the App infringes your copyright, please contact us with:

  • Description of the copyrighted work

  • Location of the infringing material

  • Your contact information

  • A statement of good faith belief

  • A statement under penalty of perjury that the information is accurate

13. Third-Party Services and Links

The App integrates with third-party services including:

  • Apple Screen Time API

  • Supabase (database services)

  • RevenueCat (subscription management)

  • OneSignal (push notifications)

These services are governed by their own terms and privacy policies. We are not responsible for:

  • The content or practices of third-party services

  • Any loss or damage resulting from your use of third-party services

  • Changes to third-party services that affect the App

The App may contain links to external websites. We do not endorse or control these sites and are not responsible for their content.

14. Disclaimers and Limitations of Liability

No Medical Advice

WINNR DOES NOT PROVIDE MEDICAL ADVICE. THE APP IS PROVIDED FOR INFORMATIONAL AND SUPPORT PURPOSES ONLY. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose

  • Warranties that the App will be uninterrupted, secure, or error-free

  • Warranties regarding the accuracy or reliability of content

  • Warranties that defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINNR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or use

  • Damages resulting from your use or inability to use the App

  • Damages resulting from user content or conduct of third parties

  • Any other damages relating to your use of the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 (WHICHEVER IS GREATER).

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Winnr and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Your content posted on the App

  • Your violation of any applicable laws or regulations

16. Termination

By You

You may terminate your account at any time by:

  • Using the account deletion feature in the App settings

  • Contacting our support team

  • Note: Active subscriptions must be canceled separately through iOS Settings

By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms or Community Guidelines

  • Fraudulent or illegal activity

  • Abusive or harmful behavior toward other users

  • Extended periods of inactivity

  • Any reason at our sole discretion

Effects of Termination

Upon termination:

  • Your right to access the App immediately ceases

  • We may delete your account and associated data

  • Certain provisions of these Terms survive termination (including disclaimers, limitations of liability, and indemnification)

  • You remain responsible for all charges incurred before termination

17. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of [Your State/Country], without regard to conflict of law principles.

Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except:

  • Small claims court disputes

  • Intellectual property disputes

  • Injunctive or equitable relief

The arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA). The arbitrator's decision is final and binding.

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Exception

If you do not agree to arbitration or the class action waiver, you must notify us in writing within 30 days of first accepting these Terms, and you may not use the App.

18. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Winnr regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

No Partnership

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Winnr.

We may provide notices to you through:

  • In-app notifications

  • Posting on the App

Survival

Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

20. Apple-Specific Terms

Acknowledgment

You acknowledge that:

  • These Terms are between you and WinnrWinnr, not Apple

  • Apple has no obligation to furnish maintenance and support services

  • Apple is not responsible for addressing any claims relating to the App

  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any)

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them

Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

21. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this document

  • Notify you through the App, email, or push notification

  • Request your acceptance of the new Terms

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

22. Acknowledgment and Consent

By using WinnrWinnr, you acknowledge that:

  1. You have read and understood these Terms of Service

  2. You agree to be bound by these Terms

  3. You understand the App is a support tool, not professional medical treatment

  4. You are at least 18 years of age

  5. You will use the App responsibly and in accordance with these Terms
